La Defensora de Menores apel\u00f3 en tiempo y forma, pero al beb\u00e9 ya lo mataron. El director del hospital, que pidi\u00f3 la actuaci\u00f3n de la justicia porque \u201cno se encontraba autorizado legalmente para llevar adelante la pr\u00e1ctica\u201d, no esper\u00f3 que la justicia resuelva. Una causa judicial plagada de irregularidades.<\/p>\n<p>El aborto fue solicitado en el Hospital Art\u00e9mides Zatti de Viedma, por los padres de una nena de 13 a\u00f1os embarazada tras una violaci\u00f3n. El director del hospital, Gonzalo Toundaian, pidi\u00f3 una autorizaci\u00f3n judicial y los padres de la menor presentaron un recurso de amparo. El violador ser\u00eda el concubino de su abuela de 64 a\u00f1os que ven\u00eda abusando de la nena desde hac\u00eda un a\u00f1o \u2013seg\u00fan consta en el amparo-.<\/p>\n<p>El 18 de mayo la Sala \u00abB\u00bb de la C\u00e1mara en lo Criminal de la Provincia de R\u00edo Negro, autoriz\u00f3 por mayor\u00eda el aborto. Se manifestaron a favor los jueces Jorge Bustamante y Pablo Estrabou -que no firm\u00f3 su fallo por encontrarse en uso de licencia-, y en disidencia el juez Antonio Cerdera. Ese mismo d\u00eda y sin esperar el plazo previsto para la apelaci\u00f3n, se cometi\u00f3 el irreparable crimen.<\/p>\n<p>La apelaci\u00f3n est\u00e1 en manos del Superior Tribunal de Justicia, que podr\u00eda expedirse para sentar jurisprudencia.
