{"id":11370,"date":"2021-03-22T22:49:22","date_gmt":"2021-03-23T01:49:22","guid":{"rendered":"https:\/\/www.sabado100.com.ar\/?p=11370"},"modified":"2021-03-22T22:49:22","modified_gmt":"2021-03-23T01:49:22","slug":"la-justicia-declaro-inconstitucional-el-aborto-en-san-luis","status":"publish","type":"post","link":"https:\/\/sabado100.com.ar\/es-ar\/la-justicia-declaro-inconstitucional-el-aborto-en-san-luis\/","title":{"rendered":"La Justicia declar\u00f3 inconstitucional el aborto en San Luis"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">La jueza Mar\u00eda Eugenia Bona estableci\u00f3 la plena vigencia del art\u00edculo 19 del C\u00f3digo Civil y Comercial que \u00abreconoce la existencia de la persona humana desde la concepci\u00f3n\u00bb, por lo que declar\u00f3 la \u00abinconstitucionalidad\u00bb y \u00abla inconvencionalidad\u00bb de los art\u00edculos 4 apartado 1 y 2, y apartados a, b y c, de la ley nacional 27.610 de Interrupci\u00f3n Voluntaria del Embarazo (IVE) en la provincia de San Luis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La magistrada sanluise\u00f1a no hizo lugar, sin embargo, al pedido sobre el inciso \u201cd\u201d del art\u00edculo 2, entendiendo que se trata de \u201cmedidas preventivas y de educaci\u00f3n sexual que no violentan derechos constitucionales, ni afectan al art\u00edculo 19 del C\u00f3digo Civil y Comercial\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La sentencia dio lugar a la presentaci\u00f3n judicial de la exsenadora Liliana Teresita Negre de Alonso contra dos art\u00edculos de la ley de aborto.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El fallo judicial establece \u00abla plena vigencia del art. 19 del C\u00f3digo Civil y Comercial\u00bb, que estipula que\u00a0 \u00abla existencia de la persona humana comienza con la concepci\u00f3n\u00bb, y \u00abconforme principio iuria curia novit\u00bb. Desde all\u00ed, establece \u00abla inconstitucionalidad y la inconvencionalidad de los art\u00edculos 4 apartado 1, y art. 2 apartado a, b y c de la Ley 27.610\u00bb, de la IVE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El art\u00edculo 1 de la IVE se\u00f1ala la intenci\u00f3n de \u00abregular el acceso a la interrupci\u00f3n voluntaria del embarazo y a la atenci\u00f3n postaborto, en cumplimiento de los compromisos asumidos por el Estado argentino en materia de salud p\u00fablica y derechos humanos de las mujeres y de personas con otras identidades de g\u00e9nero con capacidad de gestar\u00bb, con el objetivo de \u00abcontribuir a la reducci\u00f3n de la morbilidad y mortalidad prevenible\u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Por su parte, los inc\u00edsos a, b y c de la ley establecen la potestad de \u00abdecidir la interrupci\u00f3n del embarazo\u00bb conforme a la 27.610 , \u00abrequerir y acceder a la atenci\u00f3n de la interrupci\u00f3n del embarazo en los servicios del sistema de salud,\u00bb y \u00abrequerir y recibir atenci\u00f3n postaborto en los servicios del sistema de salud, sin perjuicio de que la decisi\u00f3n de abortar hubiera sido contraria a los casos legalmente habilitados\u00bb<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La inconstitucionalidad e inconvencionalidad se ampara en los art\u00edculos 27 de la Convenci\u00f3n de Viena, 1 y 4 de la Convenci\u00f3n de los Derechos Humanos, (Pacto de San Jos\u00e9 de Costa Rica), 1, 2 y 3 de la Convenci\u00f3n sobre los Derechos del Ni\u00f1o (CDN) los 75 inc\u00edso 22 de la Constituci\u00f3n Nacional (CN) y los 49 y 210 de la carta magna de de la provincia de San Luis y jurisprudencia citada, art\u00edculo 75 inciso 23 CN.<\/p>\n\n\n\n<p
